Driver Terms

Welcome to DriversNow.co.za ("DriversNow", "we", "us" or "our").

DriversNow offers a way for companies and drivers to connect. These Driver Terms ("Terms") are entered into by DriversNow and the person agreeing to these Terms by accessing and using our services ("Driver", "you" or "your").

These Terms govern your access to and use of the Platform and are effective from the date you create an account or use our services.

These Terms should be read together with our Privacy Policy. Both documents apply to your use of our services, so it's important to read and understand them.

"Driver" means you, the prospective employee who has created a profile on the Platform seeking employment opportunities.

"Company" or "Employer" means a company that has signed up to the Platform with the intention to recruit Drivers, or the individuals who represent that company.

"Contact Request" means a message or expression of interest sent via the Platform from a Company to a Driver.

"Job Offer" is a formal, binding offer of employment directed by a Company to a Driver.

"Platform" means DriversNow's online marketplace available on our website.

"Start Date" means the first working day of a Driver at a Company.

"Terms" means these Driver Terms of Use.

"Profile" means the information you provide about yourself on the Platform, including your experience, qualifications and availability.

To use DriversNow, you'll need to register an account. In doing so, you must provide us with accurate information about your identity, contact details, driving experience, licences, Professional Driving Permits (PrDP) and other information necessary for your Profile.

Account passwords and login details must be treated as confidential. If you know or suspect that someone else is using your account credentials, please notify us immediately. Subject to these Terms, you retain ultimate administrative control over your account, Profile and the content within it.

After your registration as a Driver has been accepted by us, you will be able to make your Profile visible to Companies. Companies will then have the opportunity to send you Contact Requests. You should respond to Contact Requests within a reasonable time, but you are not obliged to accept any Contact Request or to engage with any Company that contacts you.

Once a Company has sent you a Contact Request and you have responded, you may use other means of communication outside the Platform. Until you have received a Contact Request from a Company, you agree not to attempt to circumvent DriversNow by contacting Companies outside of the Platform. We may remove any Driver who attempts to do this from the Platform.

You warrant that all information on your Profile is true, accurate and complete. Providing false or misleading information — including regarding your licence, PrDP, experience or qualifications — may result in immediate removal from the Platform.

DriversNow is completely free for Drivers. We will never ask you to pay a fee to create a Profile, browse Companies or be considered for opportunities.

If you accept a Job Offer, we ask that you notify DriversNow within 5 (five) business days and, on request, provide us with the key terms of your Job Offer, including your Start Date and remuneration. This helps us track successful placements and improve our service.

DriversNow charges Companies — not Drivers — for successful placements. No placement fee, commission or charge will ever be payable by you.

Once your Profile is active, it will be published and available for verified Companies to view. Companies will be able to see the information you provide on your Profile, including your experience, licences and availability.

You can choose to make your Profile visible or hidden at any time through your account settings. When hidden, Companies will not be able to view your Profile or send you Contact Requests.

You are responsible for keeping your Profile up to date, including your availability, licence status and contact details.

As a Driver using DriversNow, you agree to:

• Provide accurate and truthful information on your Profile at all times.
• Maintain a valid driving licence and, where applicable, a valid Professional Driving Permit (PrDP).
• Respond to Contact Requests in a timely and professional manner.
• Not engage in any fraudulent, misleading or unlawful conduct on the Platform.
• Not request or accept any payment from a Company in exchange for being considered for a role.
• Respect the confidentiality of Company information and not misuse any information gained through the Platform.
• Comply with all applicable South African laws, including traffic and road safety regulations.

Any personal data you share with us will be treated in accordance with our Privacy Policy. We take your privacy seriously and will treat your information with respect.

Verified Companies will be able to process the personal information you provide on the Platform once you respond to a Contact Request.

You agree to keep all information gained from using DriversNow confidential, including details about Companies, job postings and other Drivers. You agree to keep your login details secret and not to divulge them to anyone.

You own all the data and content you provide to us to use the Service and upload to the Platform. In order for us to provide the Service to you, you grant us a worldwide, non-exclusive, royalty-free right and licence to access, store, host, transmit and otherwise use your content and data as required to provide the Service and make it available to verified Companies.

You are solely responsible for securing and backing up your data and content.

DriversNow owns all right, title and interest in the Service, the Platform and all intellectual property rights therein, which shall remain with DriversNow and its licensors. You shall obtain no ownership or other rights in the Service or any part of it by virtue of your use.

The Service is provided on an "as is" and "as available" basis. The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

DriversNow does not guarantee that you will receive a Job Offer, be contacted by a Company, or secure employment through the Platform. We do not guarantee the accuracy, completeness or reliability of any Company profile or job posting.

You agree to indemnify, defend and hold harmless DriversNow, its employees, officers, directors, affiliates, successors and permitted assigns from and against any and all claims, damages, obligations, losses, liabilities, costs or expenses (including attorney's fees) which arise out of or relate to:

• your breach of these Terms or your use of the Service;
• your negligent or unlawful acts or omissions;
• any data you provide to us being inaccurate, misleading or infringing the rights of any third party; or
• any failure by you to comply with applicable laws and regulations.

You may cancel your account at any time by contacting us or adjusting your profile settings. Upon cancellation, your Profile will be removed from the Platform.

We may cancel or terminate your access to the Service at any time, without prior notice or liability, for any reason, including without limitation if you breach these Terms, provide false information on your Profile, or engage in conduct that we determine is harmful to the Platform, Companies or other Drivers.

Governing Law. These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

Changes to These Terms. We may update these Terms from time to time. We will notify Drivers of material changes by email or through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DriversNow regarding your use of the Platform.
