Terms of Business

Welcome to DriversNow.co.za ("DriversNow", "we", "us" or "our").

These Terms of Business ("Terms") govern the relationship between DriversNow and companies, employers, and their authorised representatives ("Company", "you" or "your") who use our platform to browse, contact and hire drivers.

By creating a company account, submitting your registration, or using our services, you confirm that you have read and agree to be bound by these Terms.

"Driver" means a prospective employee who has created a profile on the Platform seeking employment opportunities.

"Platform" means the DriversNow website and online marketplace.

"Contact Request" means a message or expression of interest sent from a Company to a Driver through the Platform.

"Placement" means the hiring, contracting or engagement of a Driver by a Company identified through the Platform.

"Registration Number" means your official company registration number issued by the Companies and Intellectual Property Commission (CIPC) or equivalent authority.

"Verification" means the review process by which DriversNow confirms a Company's details before granting full access.

DriversNow provides Companies with access to an online marketplace of Drivers seeking employment. Our services include allowing verified Companies to browse Driver profiles, send Contact Requests, post job vacancies and manage their hiring pipeline.

DriversNow acts as a marketplace facilitator. We are not a party to any employment relationship between a Company and a Driver. We do not employ Drivers and are not involved in the terms of any employment agreement between you and a Driver.

You acknowledge that our services do not include performing background checks, criminal checks or reference checks on Drivers. You are responsible for conducting your own due diligence on all candidates, including verifying qualifications, licences, Professional Driving Permits (PrDP), references and right-to-work status.

To use our services, you must register an account and complete the company verification process. This includes providing accurate and current company details, your CIPC Registration Number, company name and company address.

Our team reviews all company registrations before granting full access. This process ensures that all companies joining the marketplace are legitimate employers. Until your registration is approved, your access will be limited — Driver names will be hidden and you will not be able to contact Drivers or create job postings.

You warrant that all information provided during registration is true, accurate and complete. Providing false or misleading information may result in immediate suspension of your account.

You must keep your account credentials confidential and are responsible for all activity that occurs under your account. You agree to notify us immediately if you suspect any unauthorised use of your account.

As a Company using DriversNow, you agree to:

• Use the Platform solely for the purpose of identifying and hiring Drivers for legitimate employment opportunities within your business.
• Provide accurate and truthful information in all job postings and communications with Drivers.
• Comply with all applicable South African labour laws, including the Basic Conditions of Employment Act, the Employment Equity Act and the Occupational Health and Safety Act.
• Not discriminate against any Driver on the basis of race, gender, age, disability or any other protected ground.
• Not request or accept any payment, fee or commission from a Driver in exchange for employment or consideration for a role.
• Respect the confidentiality of Driver information and not share, sell or distribute Driver profiles to third parties.

Verified Companies may browse Driver profiles and send Contact Requests through the Platform. All initial communication with a Driver must be initiated through the Platform.

You agree to use Contact Requests responsibly and only for genuine employment opportunities. You may not use the Platform to send unsolicited marketing, spam or fraudulent offers.

Once a Driver has responded to your Contact Request, you and the Driver may communicate through other channels. However, we encourage continued use of the Platform's messaging features to maintain a record of your communications.

Verified Companies may create and publish job postings on the Platform. You are responsible for ensuring that all job postings are accurate, lawful and do not contain misleading information regarding salary, duties or conditions of employment.

DriversNow reserves the right to remove or modify any job posting that we believe, in our sole discretion, violates these Terms or is otherwise inappropriate.

DriversNow offers pricing plans which may include a pay-per-hire model or an unlimited subscription. The applicable fees and billing terms will be set out in your selected plan and confirmed at the time of subscription.

For pay-per-hire plans, a placement fee becomes payable when a Driver identified through the Platform is hired or contracted by your Company. The fee structure will be as set out in your plan.

All fees are exclusive of applicable taxes, including Value Added Tax (VAT), where applicable. Invoices are payable within the terms specified on the invoice.

If you hire a Driver identified through the Platform outside of an active subscription or without going through the Platform's Contact Request process, you remain liable for the applicable placement fee.

12-month minimum term. Monthly subscription plans — both Driver Marketplace plans and Managed Hiring plans — run for a minimum term of twelve (12) months from your subscription start date.

Cancellation fee. If you cancel a monthly plan before the end of its 12-month minimum term, a cancellation fee equal to the balance of the remaining monthly plan fees for the full 12-month term becomes payable on cancellation. The cancellation fee is calculated on the monthly plan fee in force at the time of cancellation, is not a penalty on top of those fees, and is immediately due and payable.

Moving from Pay per hire to a monthly plan. You may move from the Pay per hire plan onto a monthly plan only once you have no candidates in process — meaning no candidates in your hiring pipeline at the messaging, interview or offer stage, and no offer still awaiting a Driver's response. Once you are on a monthly plan you may change between the monthly plans as your hiring needs change, but you may not return to Pay per hire during the minimum term.

The Platform, including its content, design, software and branding, is owned by DriversNow and protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from the Platform without our prior written consent.

You retain ownership of any content you submit to the Platform, including job postings and company branding. By submitting content, you grant DriversNow a non-exclusive licence to use, display and process that content for the purpose of operating the Platform.

To the fullest extent permitted by law, DriversNow shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Platform, including but not limited to any failure to hire a suitable Driver, any hiring decision made based on Driver profiles or the conduct of any Driver.

DriversNow does not guarantee the accuracy, completeness or reliability of any Driver profile or information provided on the Platform. You rely on such information at your own risk.

Our aggregate liability for any claim arising out of or relating to these Terms shall not exceed the total fees paid by you to DriversNow in the twelve (12) months preceding the event giving rise to the claim.

You may terminate your account at any time by contacting us. Upon termination, your access to the Platform will be disabled.

DriversNow may suspend or terminate your account at any time if you breach these Terms, provide false information during registration or engage in conduct that we determine is harmful to the Platform, Drivers or other Companies.

Termination does not relieve you of any obligations that accrued prior to termination, including any unpaid placement fees. Where you cancel a monthly plan before the end of its 12-month minimum term, the cancellation fee set out in Section 8 applies and becomes payable on cancellation.

Governing Law. These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

Changes to These Terms. We may update these Terms from time to time. We will notify Companies of material changes by email or through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DriversNow regarding your use of the Platform.
